Designtide is a service provided by TechWings sp. z o.o., a company registered in Poland ("we", "us", or "our"). We are committed to protecting your personal data and complying with applicable data protection laws, including the GDPR. This Privacy Policy explains what information we collect, how we use it, and your rights in relation to it.

By using our platform or services, you agree to the collection and use of information as described in this policy.

2. Information We Collect

We collect the following categories of information:

Account information: name, email address, company name, and password when you register.

Billing information: payment method details processed securely through our payment provider. We do not store full card numbers on our servers.

Project data: briefs, uploaded files, feedback, messages, and other content you submit through the platform.

Usage data: pages visited, features used, session duration, device type, browser, and approximate location derived from your IP address. On our website and in the application this is collected through analytics cookies only after you accept them. Essential cookies, which do not identify you, are used either way.

Communications: emails and messages you send to our team.

3. How We Use Your Information

We use your information to:

- Provide and operate the Designtide platform and deliver your subscriptions. - Process payments and manage billing. - Communicate with you about your projects, account, and service updates. - Improve our platform through usage analytics. - Comply with legal obligations.

We do not sell your personal data to third parties.

4. Project Content and Deliverables

Files, briefs, and assets you upload remain your property. We use this content solely to deliver your requested creative work. We will not share your project content with third parties outside of the team assigned to your project.

With your prior written consent, we may use completed deliverables in our portfolio or marketing materials.

5. Data Sharing

We share your data only with:

- Payment processors (e.g. Stripe) to handle billing securely. - Cloud infrastructure providers for hosting and storage. - Google Ireland Limited, for Google Tag Manager and Google Analytics, used to measure how our website is used. Analytics only run on our website once you accept analytics cookies. - PostHog, for product analytics within the Designtide application, hosted in the European Union. These analytics run only once you accept analytics cookies. Separately, our servers send PostHog a record of subscription purchases, plan changes and cancellations, so we can understand how the service is used; this relies on our legitimate interest and involves no cookies. - Legal authorities when required by law.

All third-party providers are contractually required to handle your data in accordance with applicable privacy laws.

6. Data Retention

We retain your account and project data for as long as your account is active or as needed to provide services. If you cancel all subscriptions and request account deletion, we will delete your personal data within 30 days, except where retention is required by law.

7. Cookies

We use two kinds of cookies.

Essential cookies keep the service working: they maintain your session, remember preferences, and record your cookie choice itself. These are always set, because the service cannot function without them. The cookie storing your choice is named designtide_consent and is shared across designtide.co and app.designtide.co, so you are only asked once.

Analytics cookies measure how the website is used, through Google Analytics (cookies named _ga and _ga_ followed by an identifier, kept for up to 2 years), and how the application is used, through PostHog (a cookie whose name starts with ph_, kept for up to 1 year). These are set only after you accept them. Until you do, Google Analytics runs in a restricted mode that sets no cookies and does not identify you, and PostHog does not run at all. If you decline, no analytics cookies are set.

You can change your choice at any time using the button below, which reopens the cookie banner. Withdrawing is as straightforward as consenting, takes effect immediately, and deletes the analytics cookies already set. The same choice applies on designtide.co and app.designtide.co, and can be changed from either. You can also control cookies through your browser settings, though disabling essential cookies may affect how the service works.

8. Your Rights

Depending on your location, you may have the right to:

- Access the personal data we hold about you. - Request correction of inaccurate data. - Request deletion of your data. - Object to or restrict certain processing. - Data portability.

9. Security

We implement industry-standard security measures including encryption in transit (TLS), encrypted storage, and access controls. However, no method of transmission over the internet is 100% secure. We encourage you to use a strong, unique password for your account.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes via email or a notice on the platform. Continued use of the service after the effective date constitutes acceptance of the revised policy.
